1. Agreement to Terms
By downloading, installing, or using Tree Identifier: AI Scan & ID ("the App"), operated by NextPixel Apps ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the App.
2. Description of Service
Tree Identifier is a mobile application that uses artificial intelligence to help users identify tree and plant species from photographs. The App may provide:
- AI-powered tree and plant identification from photos
- Detailed information about identified species
- History tracking of your identifications (stored on your device)
- Export or sharing features where available
Identification features rely on third-party AI services (Google Gemini and OpenAI ChatGPT). Use of those features requires your explicit consent, as described in our Privacy Policy.
3. AI Services & Consent
When you use identification features, photos you capture or select may be transmitted to Google Gemini and/or OpenAI ChatGPT solely to generate identification results.
- We obtain your explicit consent through an in-app dialog before sending images to these providers.
- If you decline consent, AI-powered identification will not be available.
- You may revoke consent at any time in the App's settings.
- Images are processed for identification and are not stored on our servers after results are delivered, unless you choose to save them in the App.

4. Subscriptions and Payments
Tree Identifier may offer free and premium features. Pricing displayed in the App Store controls at the time of purchase. Typical offerings may include:
- Free Tier: Limited access to basic identification features
- Weekly Plan: $3.99 per week
- Monthly Plan: $9.99 per month
- Lifetime Access: $19.99 one-time purchase
Actual prices, currencies, and plan availability may vary by region and App Store listing. Payment is charged to your Apple ID account through the App Store. We do not collect or store your payment card details.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
5. Subscription Terms
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in your Apple ID Account Settings on the App Store after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
- Refund requests are handled by Apple according to Apple's refund policies.
6. Acceptable Use
When using Tree Identifier, you agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, modify, scrape, or hack the App or its APIs
- Not use the App to violate any laws or regulations
- Not distribute, resell, or share your subscription access with others
- Not upload unlawful, harmful, or infringing content
7. Accuracy Disclaimer
While we strive for high accuracy, Tree Identifier is provided for informational and educational purposes only. The App:
- Should not be relied upon as the sole source for plant or tree identification
- May not accurately identify all species
- Should not be used to determine if a plant is safe to consume, touch, or burn
- Is not a substitute for professional botanical, medical, or arboricultural advice
You are solely responsible for how you use identification results.
8. Intellectual Property
All content, features, and functionality of the App — including design, graphics, text, trademarks, and code — are the exclusive property of NextPixel Apps or its licensors and are protected by copyright, trademark, and other intellectual property laws. Identification results may include information generated by third-party AI services; that does not transfer ownership of the App or our trademarks to you.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which explains what data we collect, how AI providers process photos, and your rights. By using the App, you acknowledge that policy.
10. Limitation of Liability
To the fullest extent permitted by law, NextPixel Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, profits, or goodwill — resulting from your use of or inability to use the App, reliance on identification results, or third-party AI service outages or errors.
11. Indemnification
You agree to indemnify and hold harmless NextPixel Apps from any claims, damages, losses, or expenses arising from your use of the App, your content, or your violation of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App or on this website with an updated "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.
13. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. You may stop using the App at any time and cancel subscriptions through Apple.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
